Welcome to Createfy. These Terms of Use govern access to and use of the platform available at https://createfy.app, provided by Createfy [RAZÃO SOCIAL], CNPJ (Brazilian company registration number) [CNPJ] (“Createfy”, “we”). By creating an account or using the platform, you agree to these Terms. Please read them carefully — they define what you may and may not do.
1. Acceptance and definitions
By accessing or using Createfy, you confirm that you are at least 18 years old (or have reached the minimum legal age and have full legal capacity in your country) and that you agree to these Terms and to the Privacy Policy, which forms part of them. If you do not agree, do not use the platform. “Connected Account” means the Instagram account or Facebook Page you link; “User Content” means the texts, images and materials you create or upload.
2. Description of the service
Createfy is a platform for creating, organizing and publishing social media content, with artificial intelligence features and integration with Instagram and Facebook. The service is provided “as is” and may evolve, with features being added or removed.
3. Registration, account and security
You are responsible for providing accurate information, for keeping your credentials and tokens secure, and for all activity carried out in your account.
- Do not share your password or access tokens with third parties.
- Keep your email and phone number up to date — we use them for critical alerts and account recovery.
- Notify us immediately if you suspect unauthorized access.
4. Acceptable use
You agree not to use the platform for unlawful purposes or to: generate or publish content that is illegal, offensive, defamatory or that infringes third-party rights (including copyright); send spam; engage in harassment; carry out reverse engineering or unauthorized scraping; overload the infrastructure; distribute malware; or violate the policies of the connected social networks (Meta and others). Non-compliance may lead to suspension or termination of the account.
5. AI-generated content
Texts and images generated by artificial intelligence are provided without warranties of accuracy or originality. You own the outputs, but you are solely responsible for reviewing them before publishing. We are not liable for inaccuracy, plagiarism or infringement of rights in generated content.
6. User Content and intellectual property
Createfy retains all rights to the software, the brand and the interface, and grants you a limited, non-exclusive, non-transferable and revocable license to use them. User Content remains yours; you grant us a restricted license to store, process, display and publish that content on your Connected Accounts, at your request, for the sole purpose of operating the service.
7. Integration with Instagram and Facebook (Meta)
When you connect an Instagram account or a Facebook Page, the following conditions apply:
- You represent that you own the connected accounts or have express authorization to manage them, and you are responsible for that authorization.
- Createfy accesses and acts on the connected accounts exclusively on your behalf, according to your instructions, using only the permissions you granted via the Graph API — nothing beyond what was authorized.
- You agree to comply with the Instagram/Facebook Terms and the Meta Platform Policies. Violations may lead to the integration being interrupted.
- Createfy is not affiliated with, sponsored, endorsed or administered by Meta Platforms, Inc. “Instagram” and “Facebook” are trademarks of Meta, mentioned for descriptive purposes only.
- You may revoke the connection and unlink your accounts at any time, on the platform or in Meta’s settings.
- Meta may change, limit or discontinue its APIs at any time, which may affect or interrupt features, without this constituting a breach on our part.
8. Plans, payment, right of withdrawal and 7-day guarantee
Each workspace has a monthly usage quota according to its plan, reset on the first day of each month. Whenever there are charges, we will clearly inform you of the prices, the billing cycle and any renewal. For contracts made over the internet, you have the right to withdraw within 7 days of the purchase, with a refund, under article 49 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor).
7-day guarantee. Within that same 7-day period from the purchase, if you conclude that Createfy does not suit your business, we will refund 100% of the amount paid, with no justification required. The guarantee applies to any plan and carries no penalty. To request it, simply contact us through our support channels and provide your account email; the refund is made through the same payment method used for the purchase. Using the service during this period does not affect your right to a refund, except in proven cases of fraud or abuse.
9. Disclaimer of warranties and limitation of liability
The service is provided “as is”, with no guarantee of uninterrupted availability or of specific results. To the fullest extent permitted by law, we are not liable for indirect damages or loss of profits, nor for unavailability, blocks, rate limits or moderation actions applied by Meta to your accounts. Nothing in these Terms excludes liabilities that cannot be excluded under applicable law, especially the Brazilian Consumer Protection Code.
10. Suspension and termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms, generate abusive content, are in payment default, or when required by law. Once the account is closed, access is discontinued and the data is deleted as described in the Privacy Policy; clauses that by their nature should survive (intellectual property, limitation of liability and jurisdiction) remain in force.
11. Privacy and data protection
Personal data is processed in accordance with the LGPD (Brazil’s General Data Protection Law) and is described in detail in our Privacy Policy. To request deletion of your data, see the Data Deletion page.
12. Changes to the Terms
We may change these Terms. Material changes will be communicated by email or by a notice on the platform, with reasonable advance notice. The date of the last update appears at the top of this page.
13. Governing law and jurisdiction
These Terms are governed by Brazilian law. For consumer relationships, the courts of the consumer’s place of domicile are guaranteed, as provided by the Brazilian Consumer Protection Code. For all other relationships, the courts of the judicial district of [CIDADE/UF] are elected.
